Expressions of Interest are invited from suitably qualified Applicants for the works and services described below. This procurement is subject to the World Trade Organization Agreement on Government Procurement.
1. Background Information
The Northern Link is envisaged as a key transport infrastructure in the Northwest New Territories and New Territories North, which will connect the Tuen Ma Line (TML) and the East Rail Line (EAL), forming a loop in the northern New Territories. Following the granting of Policy Support by the Executive Council, the Transport and Housing Bureau (THB) invited the Corporation to proceed with the detailed planning and design of Northern Link. The Northern Link project will be implemented in phases, and a new Kwu Tung Station will be built on the existing EAL between Sheung Shui Station (SHS) and Lok Ma Chau Station (LMC), and it will serve as an interchange station between EAL and the Northern Link later after the new link commences service. The THB invitation is premised on the completion of the new station by Year 2027.
Expressions of Interest are invited from suitably qualified contractors who have the necessary experience, capability and resources to carry out the similar works.
2. Scope of Works
2.1 Contract 1601 will be tendered and awarded as a Design and Build Contract, using NEC4 Engineering and Construction Contract June 2017 (with amendments October 2020) – Option C: Target contract with activity schedule. In keeping with the Corporation’s partnering approach, preference will be given to contractors who can clearly demonstrate and encourage a collaborative working approach and a shared commitment to achieving a successful project outcome.
2.2 The major elements of works comprise the construction of:
i) A new intermediate station on the EAL between Lok Ma Chau Station (LMC) and Sheung Shui Station (SHS), namely Kwu Tung Station on East Rail Line ‘KTU(EAL)’;
ii) Modification of existing Emergency Access Points (EAPs) of EAL at Kwu Tung;
iii) Protection and modification of existing EAL Lok Ma Chau Spur Line (LMCSL) enabling tunnel box;
iv) Enabling works at KTU(EAL) for future expansion of Kwu Tung Station for NOL ‘KTU(NOL)’ including civil, architectural and BS, E&M systemwide;
v) Division of existing EVA and associated works;
vi) Trackside auxiliaries system for KTU(EAL), including interfaces with and modification of existing EAL;
vii) Temporary traffic diversion, temporary utilities diversion and/or permanent utilities diversion to allow construction of the Works; and
viii) Design and construction of building services.

4. Expressions of Interest
To be considered for prequalification, interested parties having relevant resources, qualifications and experience are requested to express their interest on or before 2:00 p.m. on 7 July 2022 (Hong Kong Time) via the MTR Corporation Limited’s E-Tendering System. Late applications shall not be considered.

5. Deadline to Return Answers / Information
Suitable Applicants shall receive a prequalification invitation via the E-Tendering System. The Applicants shall complete and submit all required information and details via the E-Tendering System no later than the time and date specified in the prequalification invitation letter.

6. Other Matters
As part of the required information each Applicant shall be required to submit audited accounts covering the three years prior to the date set for submission. When an Applicant is a joint venture then each partner shall submit separate accounts.
Applicants responding to this advertisement are deemed to have complied with the Personal Data (Privacy) Ordinance in the collection and transfer of personal data to MTR Corporation Limited. All information submitted including personal data, shall be used by MTR Corporation Limited for the prequalification of tenderers for this project.
Applicants shall note and make themselves aware of the Corporation’s ethical and probity requirements which shall be applied throughout the tender and contract periods. Further, Applicants shall not, and shall ensure that its directors, employees, agents and sub-contractors shall not, offer or give any advantage as defined in the Prevention of Bribery Ordinance (Cap. 201) to any employee or agent of MTR Corporation Limited. Any breach or non-compliance with this paragraph by the Applicant shall, without affecting its liability for such breach or non-compliance, result in its application not being considered.
