Expressions of Interest are invited from suitably qualified Applicants for the works and services described below. This procurement is subject to the World Trade Organization Agreement on Government Procurement.
1. Background Information
The Northern Link (NOL) will be a key transport infrastructure, connecting the Tuen Ma Line (TML) and the East Rail Line (EAL) and forming a loop in the northern New Territories to link with the railway network.
The NOL project will be implemented in phases. A new Kwu Tung Station on the East Rail Line (KTU(EAL)) is under construction on the existing EAL between Sheung Shui Station (SHS) and Lok Ma Chau Station (LMC). NOL Main Line involves the construction of a proposed underground railway to link Kam Sheung Road Station (KSR) on TML and KTU on EAL with three intermediate stations at Au Tau, Ngau Tam Mei and San Tin. NOL Ancillary Works will commence in 2025 to enable the timely commencement of the subsequent tunnel construction of NOL Main Line. The proposed works are listed in the Project Agreement of the KTU(EAL).
Expressions of Interest are invited from suitably qualified contractors who have the necessary experience, capability and resources to carry out the Works.
2. Scope of Works
Contract 1635 will be tendered and awarded as a Design and Build Contract, using NEC4 Engineering and Construction Contract June 2017 (with amendments October 2020) – Option C: Target contract with activity schedule. In keeping with the Corporation’s partnering approach, preference will be given to contractors who can clearly demonstrate and encourage a collaborative working approach and a shared commitment to achieving a successful project outcome.
The major elements of works comprise:
a) Detailed design and construction of temporary diaphragm walls for Excavation and Lateral Support (ELS) of the launching shaft of Tunnel Boring Machine (TBM) as well as for Shui Mei Road Ancillary Building (SMA) and carrying out the pumping test for adequate groundwater cut-off;
b) Detailed design and construction of a temporary power substation at San Tam Road with all necessary provisions infrastructure, civil, architectural, building services works, associated T&C and statutory inspections within the site boundary to enable CLP Power Hong Kong Limited (CLP) transformer installation and cables connection;
c) Diversion of existing utilities and drainage associated with the existing roads works, slope and retaining wall for the construction of Items a) & b);
d) Tree removal works according to statutory approval for the two areas for the construction of Items a) & b) and associated submissions to the relevant Government Departments;
e) All statutory submissions, inspections and testing and commissioning necessary for the Works; and
f) All temporary fencing works such as hoardings and security etc. during the course of the Works including modification for construction.

4. Expressions of Interest
To be considered for prequalification, interested parties having relevant resources, qualifications and experience are requested to express their interest on or before 2:00 p.m. on 13 January 2025 (Hong Kong Time) via the MTR Corporation Limited’s E-Tendering System. Late applications shall not be considered.

5. Deadline to Return Answers / Information
Suitable Applicants shall receive a prequalification invitation via the E-Tendering System. The Applicants shall complete and submit all required information and details via the E-Tendering System no later than the time and date specified in the prequalification invitation letter tentatively by the end of January 2025.

6. Other Matters
As part of the required information each Applicant shall be required to submit audited accounts covering the three years prior to the date set for submission. When an Applicant is a joint venture then each partner shall submit separate accounts.
Applicants responding to this advertisement are deemed to have complied with the Personal Data (Privacy) Ordinance in the collection and transfer of personal data to MTR Corporation Limited. All information submitted including personal data, shall be used by MTR Corporation Limited for the prequalification of tenderers for this project.
Applicants shall note and make themselves aware of the Corporation’s ethical and probity requirements which shall be applied throughout the tender and contract periods. Further, Applicants shall not, and shall ensure that its directors, employees, agents and sub-contractors shall not, offer or give any advantage as defined in the Prevention of Bribery Ordinance (Cap. 201) to any employee or agent of MTR Corporation Limited. Any breach or non-compliance with this paragraph by the Applicant shall, without affecting its liability for such breach or non-compliance, result in its application not being considered.
